What happens if you do not have a waiver?

When you try to cross the border into the United States with a criminal record and without a U.S. Entry Waiver, you could face a serious predicament. CBP (Customs and Border Protection) officers will ask for your identification. They will then enter your information into their computers to conduct an RCMP (Royal Canadian Mounted Police) criminal record search. Once the CBP officer has uncovered your criminal record they will upload your information into the Department of Homeland Security’s mainframe, resulting in an INS and FBI file in your name.

Once those files are created, no matter what your criminal record is for, you will be disfavoured and not be allowed to enter the United States. However, if you are granted a U.S. Entry waiver, you cannot receive discrimination based on your criminal record and can enter the States easily.
